Terms and Conditions (T&C)

1. Scope of Application
1.1 These General Terms and Conditions (hereinafter "T&C") apply to the use of the mobile application Parentli, hereinafter referred to as the "App", provided by Dominic Huang, hereinafter referred to as the "Provider".
1.2 The App is an affirmation and mindfulness app specifically developed for parents (moms and dads), offering psychological micro-interventions in the form of personalized affirmations.
1.3 By installing and using the App, the user accepts these T&C. If the user does not agree with individual provisions, they must refrain from using the App.
2. Description of Services
2.1 The App offers the following core functions:
- Personalized Affirmations: Display of affirmation texts adapted to the chosen persona (Mom/Dad/Neutral), the age of the children, and selected topic areas.
- Breathing Exercise (Breath Mode): A guided breathing exercise with haptic feedback and an animated breathing ring.
- Swipe Mode: Vertical swipe navigation through affirmations.
- Favorites: Option to save affirmations as favorites.
- iOS Widgets: Display of affirmations on the home screen and lock screen (iOS only).
- Local Notifications: Configurable reminders with personalized affirmation texts.
- Settings: Customization of persona, name, children's data, topic areas, font, and notification options.
- Feedback Function: Optional possibility to submit anonymous feedback regarding the App.
2.2 The affirmations provided in the App serve exclusively to support general personal well-being and do not constitute medical, therapeutic, or psychological advice. Under no circumstances do they replace professional treatment by doctors, therapists, or other qualified professionals.
2.3 The Provider reserves the right to change, expand, or restrict the functional scope of the App at any time.
3. Requirements for Use
3.1 The App is intended for individuals aged 16 and over.
3.2 No user account is required to use the App. No access data such as email addresses or passwords are collected.
3.3 The App is primarily designed for iOS devices and requires a compatible iOS version.
4. Free and Paid Content (Premium)
4.1 The App offers both free and paid content (hereinafter referred to as "Premium").
4.2 Free content includes:
- Access to standard affirmations and the "Single Parent" category
- Basic App functions (feed, favorites, settings, breath/swipe mode)
4.3 Premium content includes:
- Access to all affirmation categories (e.g., sleep deprivation, anxiety & worries, partnership, loneliness, me-time)
- Ad-free use
- iOS widget functionality
- Access to the full and growing affirmation library
4.4 The purchase of Premium content is made as an in-app purchase via the Apple App Store. Applicable prices are displayed in the App Store before purchase.
4.5 Payment processing is handled exclusively through Apple (App Store). Apple's payment terms apply.
5. Subscription and Cancellation
5.1 Premium content is offered as a subscription. The exact terms and prices are displayed in the App Store.
5.2 The subscription automatically renews for the respective term unless it is canceled at least 24 hours before the end of the current term.
5.3 Cancellation of the subscription is done via the subscription management of the Apple App Store in the device settings or within the App under Settings > Manage Subscription.
5.4 Subscription periods already paid for will not be refunded upon cancellation. Access to Premium content remains active until the end of the paid period.
5.5 Users can restore previously made purchases via the "Restore Purchases" function in the App (e.g., when changing devices).
6. Data Protection and Storage
6.1 The App follows an offline-first and privacy-by-design approach. All user-related data is stored exclusively locally on the user's device.
6.2 The following data is stored locally on the device:
- Chosen persona (Mom/Dad/Neutral) and display name
- Number and age groups of children
- Selected topic categories
- Favorited and hidden affirmations
- Viewed affirmations
- Notification settings (frequency, time window)
- Font preference and feed interaction mode
- Premium status (cached locally)
6.3 For the processing of in-app purchases, technically necessary data may be processed by Apple or RevenueCat.
6.4 Third-Party Services:
RevenueCat: Used exclusively for managing in-app purchases and subscriptions. RevenueCat processes pseudonymized purchase IDs to validate subscription status. No personally identifiable information (such as name or email) is transmitted to RevenueCat. RevenueCat's privacy policy can be viewed at https://www.revenuecat.com/privacy .
6.5 The user can completely delete all locally stored data at any time via the "Reset Data" function in the App settings. Uninstalling the App also deletes all local data.
6.6 Further information on data protection can be found in the separate Privacy Policy.
7. Notifications
7.1 The App offers the possibility to activate local push notifications with personalized affirmation texts.
7.2 Activation of notifications is voluntary and requires the explicit consent of the user via the operating system's permission prompt.
7.3 Notifications are scheduled and sent locally on the device. No push servers of the Provider are used.
7.4 Frequency (0-10 per day) and time windows for notifications can be adjusted or deactivated by the user at any time in the App settings.
8. Intellectual Property and Copyright
8.1 All contents of the App, including affirmation texts, graphics, animations, illustrations (especially the cloud mascots), design elements, and source code, are protected by copyright and are the property of the Provider.
8.2 The user is granted a simple, non-transferable, non-sublicensable right of use for personal, non-commercial use.
8.3 Copying, distributing, making publicly available, or otherwise exploiting the contents of the App beyond personal use is prohibited without the express written consent of the Provider.
9. Disclaimer of Liability
9.1 The contents of the App (especially affirmation texts and breathing exercises) serve exclusively to promote general well-being and self-care. They do not constitute medical, psychological, or therapeutic advice or treatment and do not replace professional treatment by doctors, psychologists, therapists, or other qualified professionals. The App is not a medical device within the meaning of the EU Medical Device Regulation (MDR).
9.2 In the event of health or psychological complaints, particularly depression, postpartum depression, anxiety disorders, or other serious burdens, users should seek professional medical or psychological help.
9.3 The Provider's liability is unlimited:
- in cases of intent and gross negligence,
- for damages resulting from injury to life, body, or health,
- as well as according to the provisions of the Product Liability Act.
9.4 In the event of a slightly negligent breach of essential contractual obligations (so-called cardinal obligations), the Provider's liability is limited to the contract-typical, foreseeable damage. Cardinal obligations are those obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the user may regularly rely.
9.5 In all other respects, the Provider's liability for damages caused by slight negligence is excluded.
9.6 Specifically, the Provider assumes no liability for:
- the individual suitability of the content for the user's personal or health situation,
- damages arising from the use or non-use of the provided content,
- technical malfunctions, interruptions, or limited availability of the App,
- loss of data or loss of locally stored content (e.g., due to device change, uninstallation, system errors, or hardware defects),
- disruptions caused by the operating system, the App Store, third-party providers, or force majeure.
10. Availability
10.1 The Provider endeavors to ensure the most uninterrupted usability of the App possible. Since the App functions largely offline, an internet connection is only required for the purchase and validation of Premium subscriptions.
10.2 The Provider reserves the right to discontinue the App or individual functions at any time without this giving rise to any claims by the user (with the exception of subscription periods already paid for).
11. Amendments to the T&C
11.1 The Provider reserves the right to amend these T&C at any time with effect for the future.
11.2 The currently valid version of the T&C can be viewed in the App under Settings > Legal > T&C.
11.3 In the event of significant changes, the user will be informed in an appropriate manner. Users can object to the further validity by ceasing to use the App.
12. Final Provisions
12.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2 Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.
12.3 Consumers have the right to use the European Online Dispute Resolution platform (ODR platform) at https://ec.europa.eu/consumers/odr/ . The Provider's email address is: hello@madebyhuang.de.
12.4 The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
